TERMS AND CONDITIONS FOR WASTE MANAGEMENT

The following terms and conditions shall be applicable to all services that Ryan Transportation Service, Inc. (“BROKER”) brokers to transportation carriers (each a “CARRIER”) whereby the underlying shipper is Waste Management National Services, Inc. and its affiliated entities (hereinafter collectively referred to as the “COMPANY”). These terms and conditions (i) are in addition to the Contract and any related addendums between BROKER and CARRIER, and (ii) may be modified by BROKER and COMPANY at any time. Such modifications shall take effect immediately upon being posted on this website. This website was last updated by BROKER on March 28, 2014. 

1) TRANSPORTATION CHARGES: As provided in the rate confirmation provided to CARRIER by BROKER prior to shipment.

2) OTHER FEES AND ASSESSORIALS:

  • 2.1 Fuel Surcharges: All fuel surcharges shall be applied in a manner consistent with the applicable fuel surcharge table.
  • 2.2 Chassis Rental Fees: Any chassis rental fees can be charged back to COMPANY as a direct pass-through, as long as the CARRIER provides appropriate documentation regarding the charges to BROKER. Notwithstanding the foregoing, CARRIER must notify BROKER and COMPANY prior to the rental of a chassis if the rental fee will exceed a two-day rental.
  • 2.3 Overweight Permits: Any overweight permit fees can be charged back to the COMPANY as a direct pass-through, as long as the CARRIER provides appropriate documentation regarding the charges to BROKER and COMPANY.
  • 2.4 Other Assessorial Charges: Other assessorial charges shall be as specified in the assessorial table.
  • 2.5 Scale Tickets: If a CARRIER has to pay to weigh a load in order to provide the BROKER and COMPANY a scale ticket, the scale ticket fee can be charged back to the COMPANY as a direct pass-through, as long as the CARRIER provides BROKER and COMPANY appropriate documentation regarding the charges. 3) CARRIER shall comply with following “MINIMUM STANDARDS, SPECIFICATIONS & DRIVER INSTRUCTIONS” required by COMPANY:

GENERAL

  • All of CARRIER’s drivers shall have (i) a current and appropriate state Commercial Drivers License, (ii) a copy of the vehicle registration, inspection sticker and insurance card, (iii) the most recent annual Motor Vehicle Report (not to exceed six months of current date), and (iv) a current and valid U.S. DOT required medical certificate.
  • CARRIER shall maintain current Driver Qualifications and Training files for each driver and shall keep on file all pre-trip and post-trip vehicle condition reports for a six-month period.
  • All tractors and trailers of CARRIER shall meet all current U.S. DOT and appropriate state inspections, licenses, regulations and permits, without limitation.
  • All trailers used by CARRIER for hauling solid waste shall have a minimum capacity no less than 24 tons and 130 cubic yards.

DRIVER INSTRUCTIONS

  • Hydraulic connections shall take place only on the landfill and shall be disconnected while on the landfill at low idle RPM of tractor.
  • Tractor hoses shall be kept clean and must be arranged to eliminate any chance of falling to the ground and becoming entangled with the driveshaft, fifth wheel or frame.
  • All drivers shall be 21 years or older.
  • All drivers shall utilize trailers that are properly secured and tarped prior to departure.
  • All drivers shall operate in the safest effective manner possible while in the transfer station, on public or private property, and on the landfill property by obeying all posted signs, directions from designated spotters, and applying all their experience to safely and effectively accomplish their assignment(s).
  • While operating at any pickup location, CARRIER’s drivers shall wear a hardhat and high-visibility vest when outside of their tractors.
  • All drivers shall apply their best judgment and professionalism to gauge rest or meal breaks to eliminate any convoying of our trailers (i.e., no tractor-trailer to be within three (3) miles of another tractor-trailer going in the same direction).
  • All drivers shall use only tractor-trailer routes that will accommodate all of the following:
    • Appropriate height and weight restrictions.
    • Routes that minimize time spent away from the transfer station.
    • No residential streets will be transited except at the landfill entrance and under 25 mph.
  • All CARRIER’s employees shall be courteous at all times and shall work quietly and not use loud or profane language.
  • No CARRIER’s employees shall solicit or request gratuities at any time.
  • No CARRIER’s employees shall conduct salvaging at any time.
  • All trailers provided shall be empty, and shall not have been used for the transport of Special or Hazardous Waste, as defined by any federal, state or local law, or other regulated substance, without having been cleaned prior to deployment for transport of COMPANY’s materials.
  • All trailers and other vehicles shall have clearly visible on each side the identity and telephone number of the CARRIER.
  • Driver and/or CARRIER shall not backhaul food products unless previously approved.
  • All drivers shall cooperate completely in routinely finishing documentation of each assignment, including filing appropriate paperwork with a dispatcher if any discrepancy is observed or experienced.
  • CARRIER shall inform BROKER if it receives a “Conditional” or “Unsatisfactory” safety rating with the U.S. DOT.
  • CARRIER will utilize overweight permits when allowed by law.
  • CARRIER’s drivers at all times shall comply with all safety rules for at any origin or destination.

OTHER REQUIREMENTS

  • CARRIER will look solely to BROKER, and not to COMPANY, for the payment of their charges.
  • CARRIER shall bear all costs incurred relating to its equipment, including but not limited to: (i) all costs required to operate and maintain the equipment in a safe and roadworthy condition and manner consistent with good business practices and industry standards and as required by all applicable local, state and federal laws, ordinances, regulations and permits (“Applicable Laws”); (ii) all other operating costs for or relating to the equipment, personnel (including but not limited to any taxes, labor, employee benefits, union or collective bargaining costs), insurance, fuel, permits, and licenses; and (iii) all taxes, tolls, expenses, fines and fees incurred in connection with the loading and transportation of materials.
  • CARRIER shall have personnel and equipment sufficient to provide the services in a legal and safe manner, including meeting the Minimum Standards and Specifications and other operational requirements set forth herein. CARRIER will comply with all Applicable Laws, particularly with regard to (i) the replacement of tires and brakes; (ii) legal weight limits for highway transportation; (iii) properly tarping and securing all loads; and (iv) transportation of materials, including those relating to the prevention of leaks and airborne materials.
  • BROKER and COMPANY reserve the right to impose specific performance standards and requirements as may be applicable for any particular shipment, and CARRIER agrees to comply with such requirements upon becoming aware of these requirements.
  • CARRIERS shall fully and promptly comply with all COMPANY safety and work rules that are applicable to the services and to CARRIER’s entry into and use of the any origin and destination locations.
  • CARRIER is expressly prohibited from adding or removing anything to the materials tendered to them at any point between an origin location and a destination location without express written consent of COMPANY.
  • CARRIER shall remove all of its equipment and personal property from any COMPANY facility promptly upon notice from BROKER and/or COMPANY.
